Refund Policy

What is refunded if you withdraw, on a tiered schedule set by how much of the course has been delivered.

This Refund Policy ("Policy") applies to enrollment, payment, and contract termination matters relating to the online English educational services provided by 巧克教育股份有限公司, a company registered in Taiwan, trading as "Choc Education" (referred to herein as "Choc Education"). This Policy is incorporated by reference into the Student Enrollment Agreement & Educational Services Terms.

This Policy is established in accordance with the Consumer Protection Act of the Republic of China (Taiwan) and the "Mandatory and Prohibited Provisions of Standard Contracts for Internet Teaching Services" (網際網路教學服務定型化契約應記載及不得記載事項), and will be updated as the relevant laws are amended. If Choc Education subsequently obtains registration as a short-term supplementary education institution (短期補習班), this Policy will be amended and republished in accordance with the laws applicable at that time, and the new version will apply to students who enroll after the new version takes effect.

1. DEFINITIONS

"Service Commencement Date" means the first scheduled class of the course in which the student is enrolled. Access to the Choc Education learning platform granted before the course start date is provided as a post-enrollment preview and does not constitute commencement of the service; the student's access to or use of the platform before the course start date shall not be counted toward Used Hours.

"Total Contract Hours" means all course hours or sessions included in the course package in which the student is enrolled.

"Used Hours" means the live classes scheduled and actually delivered between the Service Commencement Date and the date of termination, as recorded by the Choc Education learning platform.

"Course Fees Paid" means the actual amount paid by the student for the course, after application of any promotional, referral, pay-in-full, or other discounts. All refund calculations under this Policy shall be based on Course Fees Paid, not on the standard tuition fee.

2. RIGHT TO TERMINATE

The student may at any time notify Choc Education of the termination of the enrollment contract, and Choc Education shall not refuse such notice. Termination takes effect on the date Choc Education receives the notice.

Where the student gives notice of termination before the Service Commencement Date, Choc Education shall refund in full all course fees paid by the student, without charging any handling fee, penalty, or any other fee of any kind.

3. REFUND CALCULATION ON OR AFTER THE SERVICE COMMENCEMENT DATE

Where the student terminates the enrollment contract on or after the Service Commencement Date, Choc Education shall refund the following proportion of Course Fees Paid:

  • Where Used Hours are less than one-third (1/3) of Total Contract Hours: sixty percent (60%) of Course Fees Paid.

Where Used Hours are one-third (1/3) or more but less than two-thirds (2/3) of Total Contract Hours: thirty percent (30%) of Course Fees Paid.

Where Used Hours are two-thirds (2/3) or more of Total Contract Hours: no refund is payable.

No handling fee, administrative charge, or penalty shall be deducted from a refund calculated under this Section.

Used Hours shall be determined by reference to the live classes scheduled and actually delivered between the Service Commencement Date and the date of termination, according to the system records of the Choc Education learning platform. Whether the student personally attended a delivered class does not affect the calculation. Classes cancelled by Choc Education and not rescheduled shall not be counted. The student may request those records for verification.

Where a student has elected to pay course fees in two instalments, the instalment schedule, and the consequences of non-payment including suspension of access and reinstatement, are governed by Section 13 and Section 18 of the Student Enrollment Agreement & Educational Services Terms. Suspension of access for non-payment is not a termination of the enrollment contract and does not of itself give rise to a refund entitlement.

Where a student terminates the enrollment contract while an instalment remains outstanding, the refund calculation under this Policy shall be applied to Course Fees Paid, and any amount properly owing to Choc Education in respect of course hours already delivered may be set off against any refundable amount.

4. PERFORMANCE GUARANTEE FOR LARGE OR LONG-TERM PREPAID COURSE FEES

Where a student prepays course fees for a contract period exceeding one year and the total prepaid amount exceeds NT$50,000, Choc Education shall, for the portion exceeding NT$50,000, provide a performance guarantee through one of the following methods, and shall disclose the method adopted to the student before enrollment:

  • Placement in a trust account;
  • A performance guarantee provided by a financial institution;
  • Collection and payment through a financial or electronic payment institution qualified to provide third-party payment or performance guarantee services; or
  • Another equivalent protection method recognized by the competent authority.

The student may, before enrollment, inquire with Choc Education about the specific arrangements and relevant documents for the performance guarantee described above.

5. HOW TO SUBMIT A REFUND REQUEST

The student (or, for students under eighteen (18) years of age, the student's Legal Representative) shall submit a refund request through one of the following methods:

  • Through the designated refund request function on the Choc Education learning platform;
  • By email to the Choc Education customer service mailbox; or
  • In writing, delivered to Choc Education's registered contact address.

A refund request shall state the student's name, the name of the enrolled course, the enrollment date, and the reason for the refund request (if any). A student's mere absence from classes or non-use of platform services does not constitute a refund request; the student must actively submit a request through the methods above for the termination of the contract to take effect.

6. PROCESSING OF REFUNDS

Choc Education shall refund the approved refund amount to the student within fifteen (15) business days from the date of receipt of a complete refund request.

Refunds shall be made using the student's original payment method; where the original payment method cannot process the refund, or where the parties otherwise agree, another method may be used.

Where the value of gifts, materials, or other benefits received by the student in connection with the enrollment does not exceed twenty percent (20%) of the total fees paid, Choc Education shall not require the return of such gifts upon refund, nor deduct their value from the refund amount. Where the value of gifts exceeds that proportion, or where the item is a separately charged agency-purchase item (such as physical textbooks purchased on the student's behalf), Choc Education may deal with the delivered items separately, outside the general refund proportion calculations under this Policy.

7. COMPLAINTS

A student who disagrees with a refund outcome may submit a complaint to Choc Education, and Choc Education shall appropriately handle and respond to the student within fifteen (15) days from the date the complaint is received.

8. STUDENTS UNDER EIGHTEEN

Refund requests for students under eighteen (18) years of age shall be submitted or confirmed by the student's Legal Representative; refund amounts shall in principle be returned to the original payment account or the original payer.

9. GOVERNING LAW AND JURISDICTION

The interpretation and application of this Policy shall be governed by the laws of the Republic of China (Taiwan). Disputes arising from this Policy that cannot be resolved through negotiation shall be subject to the jurisdiction of the competent courts of Taiwan, without excluding the applicable provisions of the Consumer Protection Act and the Code of Civil Procedure regarding small claims jurisdiction.

10. AMENDMENTS TO THIS POLICY

Choc Education may amend this Policy in response to changes in law or operational needs, and shall publish the amended version and its effective date on the Choc Education learning platform. For students who have completed enrollment, refund matters shall be governed by the version in effect at the time of their enrollment, except where mandatory provisions of law provide otherwise.

This Policy has been prepared in both English and Traditional Chinese. In the event of any inconsistency or conflict between the two versions, the Traditional Chinese version shall prevail.
